These Terms and Conditions (“Terms”) govern your access to and use of the websites, applications, programs, products, memberships, digital content, events, and other services offered under the Girly Fit Society brand.

Please read these Terms carefully before purchasing, accessing, or using any Girly Fit Society product or service.

Collectively, these are referred to in these Terms as the “Services.”

You must be at least 18 years old to purchase or independently use Services intended for adults unless a particular Service expressly permits participation by minors with appropriate parental or legal guardian consent.

By purchasing or using a Service, you represent that you have the legal capacity to enter into these Terms.

Prices for Services will be displayed at the time of purchase.

By submitting payment information, you authorize the applicable payment processor to charge the amount presented at checkout, including any applicable taxes or fees.

You are responsible for providing accurate billing information.

Prices, promotions, bonuses, and offers may change at any time for future purchases.

A later discount, promotion, price increase, price decrease, bonus, or different offer does not automatically entitle a previous purchaser to a refund, credit, price adjustment, or additional benefit unless expressly stated otherwise.

The applicable sales or checkout page will identify material access terms where relevant.
Purchasing access to a digital product gives you a limited, personal, non-exclusive, non-transferable, revocable license to use the materials for your own personal, non-commercial purposes.

Purchasing a product does not transfer ownership of the underlying intellectual property to you.


5. DIGITAL PRODUCTS AND PROGRAM ACCESS

The Hourglass Method™ is a fitness and wellness program that may include workouts, educational materials, nutrition resources, Habit Engineering™ content, and related tools.

The program is designed to provide general fitness, wellness, and educational information.

Your purchase provides access only to the materials and benefits expressly included in the offer you purchased.

Girly Fit Society may improve, reorganize, replace, update, or modify program materials over time, provided that such changes do not materially deprive purchasers of the core product they purchased. Specific results are not guaranteed.

6. THE HOURGLASS METHOD™

Habit Engineering™ is Girly Fit Society's branded framework for organizing and teaching principles related to consistency, habits, behavior, preparation, personal development, and lifestyle change.

Habit Engineering™ materials are provided for general educational and personal-development purposes.

They are not medical, psychological, psychiatric, therapeutic, or other licensed professional services.

Habit Engineering™ does not replace care from an appropriately qualified healthcare or mental-health professional.

7. HABIT ENGINEERING™

Girly Fit Society provides general fitness, nutrition, wellness, lifestyle, and educational information.

Unless expressly stated otherwise, Girly Fit Society does not provide individualized:
  • Medical advice
  • Medical diagnosis
  • Medical treatment
  • Physical therapy
  • Mental-health treatment
  • Dietetic services
  • Clinical nutrition services
  • Other licensed healthcare services

Information provided through our Services is not intended to replace consultation with an appropriately qualified professional.

You are responsible for determining whether a workout, exercise, nutritional practice, or other activity is appropriate for you.

Additional terms concerning physical activity, wellness information, nutrition content, individual results, and related risks are contained in our Fitness & Wellness Disclaimer, which is incorporated into these Terms by reference.

8. FITNESS, NUTRITION AND WELLNESS INFORMATION

LGirly Fit Society does not guarantee any particular result from participating in or purchasing a Service.

Results vary between individuals and may depend on numerous factors, including:

  • Sleep
  • Stress
  • Genetics
  • Starting condition

  • Health status
  • Individual circumstances

Examples, testimonials, photographs, measurements, success stories, or other customer experiences represent individual experiences and are not guarantees that you will achieve the same or similar results.

9. NO GUARANTEE OF RESULTS

Unless otherwise stated, Girly Fit Society or its licensors own the content and intellectual property made available through the Services.

  • Educational materials
  • Event concepts and branded materials
  • Marketing materials
  • Logos
  • Original copy and creative materials

Your purchase does not grant ownership of these materials.
Except where expressly permitted, you may not copy, reproduce, republish, upload, distribute, transmit, sell, license, sublicense, modify, create unauthorized derivative works from, publicly display, commercially exploit, or otherwise use Girly Fit Society materials outside your personal use.

10. INTELLECTUAL PROPERTY

You may not:
  • Share paid PDFs with friends
  • Upload program materials to shared drives
  • Post full workouts publicly
  • Screen-record paid content for redistribution
  • Share downloadable guides
  • Sell or redistribute Girly Fit Society materials
  • Upload paid materials to another website, platform, course, group, or application
  • Copy materials to create your own competing program
  • Teach or commercially distribute Girly Fit Society programming as your own
  • Remove copyright, trademark, or ownership notices
  • Share your account to allow others to avoid purchasing access

This applies whether or not you charge the recipient.

Unauthorized sharing may result in termination of access and may constitute infringement of intellectual-property rights.

11. YOU MAY NOT SHARE OR RESELL PROGRAM MATERIALS

Girly Fit Society and its associated names, branding, logos, slogans, product names, and other brand identifiers may be protected by trademark or other applicable laws.

The use of ™ identifies names or marks claimed by Girly Fit Society and does not necessarily represent federal registration.

Nothing in these Terms grants you permission to use Girly Fit Society branding for your own commercial purposes.

12. TRADEMARKS AND BRANDING

Certain Services may allow you to submit content, including:
  • Comments
  • Reviews
  • Testimonials
  • Progress updates
  • Photographs
  • Videos
  • Community posts
  • Responses
  • Messages
  • You retain ownership of original content you create.

By voluntarily submitting content directly to Girly Fit Society for publication, promotion, testimonial use, or similar purposes, you grant us the permissions reasonably necessary for the specific use you authorized.

We will handle personal information associated with such content in accordance with our Privacy Policy.

Where additional publicity or likeness rights are appropriate, we may request separate consent or a release.

  • Payments
  • Email delivery
  • Analytics
  • Event registration
  • Communications
  • Other technology and business operations

We may also link to third-party websites, social platforms, restaurants, products, videos, or other resources.

Third-party services operate under their own terms and policies.

Girly Fit Society is not responsible for the availability, security, content, practices, products, or services of third parties we do not control.


15. THIRD-PARTY SERVICES

Girly Fit Society may organize or promote in-person experiences including Girly Dates, Pilates & Petals, fitness classes, workshops, retreats, social gatherings, and other events.

Individual events may be subject to additional terms relating to:
  • Registration
  • Eligibility
  • Fitness participation
  • Assumption of risk
  • Waivers and releases
  • Photography and recording
  • Ticket transfers
  • Refunds
  • Weather
  • Venue rules
  • Event changes
  • Cancellation
  • Participant conduct
  • Vendors
  • Sponsors
  • Food and beverage
  • Other event-specific considerations

Where event-specific terms conflict with these general Terms regarding that event, the more specific event terms will control to the extent of the conflict.

Participation in fitness-based events may require acceptance of a separate Event Terms and Assumption of Risk/Liability Waiver.

16. EVENTS AND IN-PERSON EXPERIENCES

Event details may occasionally change due to circumstances such as weather, venue requirements, instructor availability, safety considerations, attendance, emergencies, or circumstances outside our reasonable control.

Where reasonably necessary, Girly Fit Society may modify an event's:
  • Location
  • Schedule
  • Programming
  • Instructor
  • Activities
  • Vendors
  • Sponsors
  • Amenities
  • Included products or experiences

Material event cancellation and refund rights will be governed by the terms disclosed for the applicable event.

The inclusion of a particular sponsor, vendor, gift, sample, food item, beverage, instructor, photographer, DJ, or other advertised event element is not guaranteed unless expressly stated as a guaranteed component of the ticket purchase.

That clause is particularly useful for something like Pilates & Petals. If a future goodie bag is advertised as containing partner products and one sponsor fails to deliver, you don't want that automatically turning into an argument that the entire ticket wasn't fulfilled.

17. EVENT CHANGES AND CANCELLATIONS

Girly Fit Society may occasionally offer:
  • Discounts
  • Promotional prices
  • Bonuses
  • Trials
  • Giveaways
  • Free resources
  • Founding-member pricing
  • Complimentary access
  • Limited-time offers
  • Eligibility and conditions may vary.

Promotional offers may be changed or discontinued for future purchases at any time unless otherwise stated.

Receiving a particular promotional offer does not create an entitlement to future promotions or the same pricing.



19. PROMOTIONS, BONUSES AND FREE OFFERS

Purchases are subject to the Refund & Cancellation Policy presented at checkout or otherwise applicable to the Service purchased.

Because certain Girly Fit Society products provide immediate access to digital materials, different refund terms may apply to digital products than to memberships, events, or other Services.

Please review the applicable refund terms before completing a purchase.

Our Refund & Cancellation Policy is incorporated into these Terms by reference.

20. REFUNDS AND CANCELLATIONS

We aim to maintain reliable access to our digital Services, but uninterrupted availability cannot be guaranteed.

Access may occasionally be interrupted because of:

  • Internet disruptions
  • Software updates
  • Security concerns
  • Third-party service failures
  • Events beyond our reasonable control

Temporary interruptions do not automatically entitle users to refunds unless required by applicable law or expressly stated in the applicable purchase terms.

Girly Fit Society may update, improve, reorganize, modify, replace, or discontinue features of its Services as the business evolves.

We will not intentionally remove the fundamental substance of a paid product merely to avoid providing what was purchased.

22. CHANGES TO SERVICES

We may suspend or terminate access to some or all Services when reasonably necessary because of:

  • Fraud
  • Payment disputes or chargebacks
  • Unauthorized account sharing
  • Intellectual-property infringement
  • Harassment or abusive conduct
  • Security threats
  • Illegal activity
  • Attempts to circumvent access restrictions

Termination resulting from a material violation of these Terms does not automatically entitle the user to a refund.


23. TERMINATION OR SUSPENSION OF ACCESS

You are responsible for your decisions, actions, and results when using Girly Fit Society Services.

Our Services provide tools, information, education, programming, and support. They do not remove your responsibility to determine what is appropriate for your circumstances.

You agree to use reasonable judgment and seek qualified professional advice when appropriate.

24. PERSONAL RESPONSIBILITY

To the fullest extent permitted by applicable law, Girly Fit Society and its owners, officers, employees, contractors, instructors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Services.

To the fullest extent permitted by applicable law, Girly Fit Society's aggregate liability arising from a particular paid Service will not exceed the amount you paid Girly Fit Society for that Service during the period giving rise to the claim.

These limitations do not apply where liability cannot legally be limited or excluded.



26. LIMITATION OF LIABILITY

To the extent permitted by applicable law, you agree to indemnify and hold harmless Girly Fit Society and its owners, employees, contractors, instructors, and agents from claims, losses, liabilities, damages, and reasonable expenses arising from your unlawful misuse of the Services, violation of these Terms, infringement of another person's rights, or content you submit in violation of law or these Terms.

27. INDEMNIFICATION

Our collection and use of personal information are governed by the Girly Fit Society Privacy Policy.

By using the Services, you acknowledge that you have had an opportunity to review the Privacy Policy.

28. PRIVACY

By using our Services, you consent to receiving communications electronically where permitted by law.

Marketing communications remain subject to applicable consent and unsubscribe requirements.


29. ELECTRONIC COMMUNICATIONS

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.

30. GOVERNING LAW

Before initiating formal legal proceedings, you and Girly Fit Society agree to make a reasonable good-faith effort to resolve disputes informally.

A party seeking resolution should provide written notice describing the dispute and requested resolution.

Nothing in this provision prevents either party from pursuing rights or remedies that cannot lawfully be restricted.

I would have a California attorney decide whether you want to add mandatory arbitration and a class-action waiver rather than copying one from another company's Terms. Those provisions have meaningful legal consequences and need to match your business and current law.


31. DISPUTES

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

32. SEVERABILITY

Failure by Girly Fit Society to enforce a provision of these Terms does not waive our right to enforce that provision later.

33. NO WAIVER

These Terms, together with any applicable:

  • Fitness & Wellness Disclaimer
  • Refund & Cancellation Policy
  • Event Terms
  • Liability Waiver
  • Photo or Video Release
  • Purchase terms
  • Membership terms

constitute the agreement between you and Girly Fit Society concerning the applicable Services.

Service-specific terms may supplement these general Terms.


34. ENTIRE AGREEMENT

We may update these Terms as our business, Services, or applicable laws change.
When we do, we will update the Last Updated date above.

Material changes will be communicated where required by applicable law.

Your continued use of the Services following an effective change constitutes acceptance where permitted by applicable law.

Changes will not retroactively deprive you of material rights relating to a completed purchase where doing so would violate applicable law.
